Montana has life without parole.  A judge decides the sentence.  The Governor has the power to grant clemency with the advice of the Board of Pardons. The Governor must have a favorable recommendation to grant clemency. However, the Governor is not bound by that recommendation.


In 2011, the state senate voted to abolish the death penalty, but the measure was defeated in the house.
